Changes to terms and conditions

I see from the latest email that some changed have been made to the terms and conditions. Please let us know what these changes were because unless we have a copy of the old terms to compare side by side it's a bit difficult. Thanks.

Sorry I've not got back to you. I've only just seen this - I thought I got alerts whenever there was a new thread started here but apparently not. Serves me right for not checking in more often.

As promised, here is break down of the key aspects of the recent changes to our Terms & Conditions. The motivation behind the changes was to bring our T&Cs in line with the rest of the industry and to make them clearer for our affiliates.

Changes to commission structures;

Previously the highest revenue share commission rate (40%) was capped up to revenues of €70,000 per month. We have removed this cap (4.2.1) and it's now unlimited.
We have removed two tiers of CPA commission (4.2.2) so now it's €150 per player above 20 players each month

The vast majority of our affiliates are on the revenue share plan and so we believe these changes will benefit most of you.

Changes to payment methods

Affiliates must sign up at least 5 players before commission will be paid (4.6).

This is discretionary and has been put in place in order to protect dublinbet.com from fraudulent activity, whereby people had been signing up to the casino, playing our games and if they lost were taking an affiliate commission. Should we have affiliates who do not manage to sign up 5 or more players but do appear to be entering into the spirit of the partnership we will have no problem in paying them, but we need this in here to protect us as and when required.

Bank wire transfers previously had a charge of €35 if the balance was under €500, this has now been changed to €25 if under €1,000.

Note: Our recommendation is that you should use Moneybookers or Neteller, where we will not charge a fee or instruct us to hold a bank transfer payment until your balance is over €1,000

Brand Protection

Clauses 7.2, 7.3, 7.4 & 7.5 have been inserted in order to protect our brand and our own marketing activity. It helps to protect our affiliates too by creating a more level playing field.

(7.2) & (7.3) Affiliates will no longer be able to register, apply to register or use any form of the Dublinbet brand name, misspellings or variations within any domain names that you use to promote dublinbet.com
(7.4) Similarly, affiliates will no longer be able to purchase or register keywords etc for the purpose of advertising on search engines or other site that use any form of the Dublinbet brand name, misspellings or variations
(7.5) Affiliates must not try to pass-off dublinbet.com or give the impression that their site is dublinbet.com. This includes the use of iframes to house dublinbet.com on an alternative domain

Thanks for the detailed answer Paul. I'm sure you knew where I was going with this. Introducing the five player minimum is a rubbish clause. Why alienate affiliates when you can just rely on the following clause to deal with those problem accounts?

13.1 Term and termination notice period. This Agreement shall remain in effect until terminated in accordance with this Agreement. Dublinbet or you may terminate this Agreement for any reason or no reason upon five (5) days prior e-mail registered or written notice, or immediately upon written notice of any material breach of the provisions of this Agreement. Upon termination, you shall no longer be entitled to use the Service.

Also, how would your treat the following scenario? I don't bring in any players and managed to recruit 50 sub-affiliates who all bring in 20 players and earn me hundreds of dollars each month. Under the terms of the agreement, as written, I wouldn't be paid. Sure, you can say you deal with things on a case by case basis, so why not deal with the problem affiliates on a case by case basis instead?

It's a bad clause from any angle and if you look at most, if not all, successful programs you will see they don't have this type of minimum quota and deal with the fraudulent affiliates in other ways. Experienced affiliates are not comfortable when payment is dependent on the whim of the affiliate manager.

Thanks for the feedback. I really appreciate it.

Yes, I can see what you're saying. As I said, that particular clause was inserted as we had just closed a number of accounts due to this happening and so we felt we had to put something in place to help us prevent it from happening. It often takes a few months for a noticeable pattern to emerge, by which time we will have paid them commission which we have no hope of retrieving so this felt like an appropriate way of dealing with the issue.

However, having listened to your feedback I'm going to remove that clause. I can see why it would come across as prohibitive and yes, we do have the discretion to deal with fraudulent activities in other ways.

Thanks again for taking the time to query it, it's only through this kind of feedback that we can tailor to the T&Cs to something that works for both of us.

Fantastic Paul. Your consideration and resulting outcome is greatly appreciated. I can understand how, when sitting down to draft new terms, you become too familiar with them and forget there are other clauses you can rely on to deal with things.
